405th T Shirts!!

Thanks! Im still thinking about ordering a few to trade for stuff, since adam said no selling... Im gonna think long and hard on this one, they are quite exspensive.
 
This can be a problem.. anything made with a 405th logo needs to go through management approval.. What if yours is different, or what if you don't feel it infringes copyright, but management does. Worse, what if Bungie (correctly) states that the UNSC name alonhside the UNSC logo is copyrighted and that by putting our name alongside it, it indicates that we're affiliated with Bungie?

If it goes through management, and is approved, it's less of an issue because when Adam is hit with a "cease and desist order" for the tshirt design, he can trackdown the design used and the creator, to stop it before it became a serious legal issue, and perhaps determine adjustments that Bungie is agreeable with. This (in conjunction with a formal charter) makes Microsoft lawyers able to say "ok, well it's taken care of, so we don't need to press charges". If there's a bunch floating around, and group policy (set by Adam) is that you can make your own 405th designs however you want to, the whole club would have to be shut down.

WHat folks fail to see is that if they don't enforce their copyright when they become officially aware of it, they LOSE that copyright. UIt's the way the copyright system works. If I can go into court and say.. "but wait a sec.. I made these shirts because THESE guys did it without a license, and I can PROVE that your company was officially aware of that event and supported it by not getting them to cease and desist.. so that makes you unable to prosecute me for using the logo too under the same conditions." If you think for ONE second, that Microsoft is going to simply throw away copyright on Halo-related items, you're mistaken. However, they MAY grant us use of the logo as long as we follow their guidelines.

Besides, wouldn't you all rather wear the same shirts as a club? Variations for EXTRA logos could also get approval. The 405th is run by someone, so it's automatically the owner's problem, the shirt makers problem, and it becomes the entire clubs problem, until there's a charter in-place that specifically states that we don't allow unapproved stuff at events.

Do what you want for personal use, but in terms of the club, everything made promotionally has to go through management, or you risk killing the club dead in it's tracks. This is a curse and a blessing, but it's also how copyright works. The OTHER group that has this same issue is the 501st.. go look at their charter and see how they had to deal with this issue. Our own charter is going to be required to have the same thing if we want to operate.

Thanks for taking the time to write that long essay... but we already decided not to make the shirts for mass production or anything like that, just one or 2 for me and my friends. Nothing that will be a problem.

You're welcome, but It wasn't just for you, I just wanted folks to know "why" we have to be that way.

Just a few shirts? that's cool, in an unofficial way ;)

Myself, I might be getting a tattoo of one of the many designs floating around the site, but I think I'll wait until there's a finalized official 405th logo when the club opens, in case I like that better.
